1. For FreightShipping Direct shipments that are delayed primarily due to causes beyond FDS's reasonable control and are not caused by Customer, Consignee or Consignor, the additional upcharge will not be assessed, but the Standard Charges will apply. Causes beyond FDS's reasonable control include, but are not limited to:

1. Acts of God
2. Acts or omissions of public authority
3. Riots, strikes or anticipated strikes, or labor disputes, including, but not limited to, other carriers, vendors or suppliers
4. Government regulations, orders or requirements
5. Disruption in ground transportation
6. Acts of public enemies or acts of terrorism
7. Disruption or failure of communications or information systems
8. Acts or omissions of Shipper, Consignee or Owner of the goods or any person or entity other than FDS's Freight
